This Video Production Agreement is made on [Contract Date] between [Company Name] ("Producer") and [Client Name] ("Client").

1. The Project

Producer will produce [describe the video, for example: a 90-second brand film and three 15-second social cutdowns] (the "Video"), as described in the proposal the parties have signed.

  • Shoot dates: [date or dates]
  • Locations: [address or addresses]
  • Delivery: final files within [15] business days of the shoot, or of receiving all of Client's materials, whichever is later

2. Pre-Production and Approvals

Producer will prepare a creative treatment, script, and shot list for Client's approval before the shoot. Changes to the approved script after the shoot may need more production time, which is billed separately.

3. The Shoot

  • Client will provide access to locations, any permits or permissions needed, and a representative on set who can approve decisions.
  • A shoot day is up to 10 hours, including setup and breakdown. Overtime is billed at 1.5 times the hourly crew rate, in half-hour increments.
  • Client is responsible for releases from its own employees and customers who appear in the Video. Producer obtains releases from talent it casts.

4. Post-Production and Revisions

Producer will edit, color grade, mix sound, and add licensed music and graphics. Two rounds of revisions are included, with notes consolidated in one document per round. Further rounds are billed at $125 per hour.

5. Fees and Payment

The production fee is $[amount]. 50% is due on signing to reserve shoot dates, and 50% on delivery of the final files. Location fees, talent, travel beyond 50 miles, and other costs Client approves are billed at cost. Invoices are due within 15 days. Final files are delivered once paid in full.

6. Usage License

Producer keeps the copyright in the Video and all footage. On full payment, Client may use the final Video in perpetuity on its own websites, social channels, and presentations, including paid social and online advertising. Broadcast and television use, and use by third parties, need a separate license. Licensed music is limited to the terms of its license. Producer may show the Video in its portfolio once it's public.

7. Raw Footage

Raw footage isn't part of the deliverables. Producer archives it for 12 months after delivery, and will transfer it on request for a fee.

8. Rescheduling and Cancellation

  • If Client postpones more than 7 days before the shoot, Producer will reschedule once at no charge.
  • Within 7 days of the shoot, 50% of the production day fee is due for a postponement or cancellation.
  • If Client cancels the project, the deposit is non-refundable, and Client pays for any work completed beyond it.
  • If weather, safety, or illness prevents the shoot, the parties will reschedule together at no extra charge.

9. Limitation of Liability

Producer carries general liability and equipment insurance. If footage is lost or damaged through equipment failure or circumstances beyond Producer's control, Producer will reshoot the affected material or refund the fees paid for it, and has no further liability. Producer's total liability is limited to the fees paid under this agreement.

10. Agreement

This agreement is governed by the laws of [state or country]. It and the signed proposal are the entire agreement between the parties, and may only be changed in writing. By signing below, both parties agree to these terms.

Frequently asked questions

Who owns the footage in a video production?

Usually the production company keeps the copyright, and the client gets a license to use the final video. Raw footage isn't delivered unless the contract says so. This template archives it and transfers it on request for a fee.

How long is a shoot day?

Commonly 10 hours including setup and breakdown, with overtime billed at a higher rate after that. Stating it in the contract avoids surprises on a long day.

Is this video production contract template free?

Yes. Read and copy the full text on this page, or edit it online and see it as your client will. When it's ready, start a free Clientary trial to send it or download it as a PDF.

Has a lawyer reviewed this template?

No. It's a general starting point written by Clientary, not legal advice, and it hasn't been reviewed by a lawyer for your situation or the laws where you and your client work. Have your own counsel review it before you use or sign it.
